NOTICE OF DECISION

Property Description: PLAN M189 LOT 19 PCL 3181; ACS CON 2 LOT 3PT PCL 8450; ACS RP 1R8506 PART 16; Roll # 5719-000-006-06600
Purpose: To seek relief from restrictions of the Township’s Zoning By-law 2013-13, as amended, specifically:
- To permit a detached private garage with a building height of two-storeys as an accessory building in the front yard, whereas Section 4.1.1.3 h.(ii) states that detached private garages shall not exceed one-storey in building height in this location; and
- To permit an accessory lot coverage of 6%, whereas Table 19.4 permits a maximum lot coverage of 2% for accessory buildings
Pursuant to Section 53(17) of the Planning Act, R.S.O, 1990, as amended, notice is hereby given as follows:
DECISION:
THAT MINOR VARIANCE APPLICATION MV1-2025 IS APPROVED SUBJECT TO SUCH STANDARD CONDITIONS AND OTHER APPLICATION SPECIFIC CONDITIONS AS IDENTIFIED HEREIN.
REASONS FOR DECISION:
The Committee believes the request to be desirable for the appropriate development and use of the lands and believes that the general intent and purpose of the Official Plan and the Zoning By-law are maintained.
CONDITIONS:
The Applicant is hereby advised that in accordance with Section 53 (41) of the Planning Act, R.S.O., 1990, the following conditions must be fulfilled within two (2) years of the date of this notice.
The Applicant is further advised that he/she shall provide evidence to the Township of Plummer Additional that each condition as stated herein has been satisfied. If these conditions are not fulfilled within two years, the application will lapse and a new application will be required.
Condition #1:
The applicants shall enter into a development plan agreement with Township.
APPEAL:
Section 53(19) of the Planning Act, R.S.O., 1990 provides as follows:
“The applicant, the Minister, a specified person or any public body may, not later than 20 days after the giving of notice under subsection (17) is completed, appeal the decision or any condition imposed by the Council or the Minister or appeal both the decision and any condition to the Tribunal by filing with the Clerk of the municipality or the Minister a notice of appeal setting out the reasons for the appeal, accompanied by the fee charged by the Tribunal.”

Take notice that an appeal to the Ontario Land Tribunal in respect to all or part of these Minor Variances may be made by filing a notice of appeal with the Township Clerk. This may be done either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting “Plummer Additional” as the Approval Authority, or by mail to 38 Railway Cres, Bruce Mines, ON P0R 1C0. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal fee of $400 can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website www.olt.gov.on.ca. If the e-file portal is down, you can submit your appeal to the Township Clerk at lcotnam@plummertownship.ca .
You will be entitled to receive notice of any changes to the conditions of the provisional consent if you have made a written request to be notified of changes to the conditions of the provisional consent.
Only individuals, corporations and public bodies may appeal decisions in respect of application for consent to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.
No person shall be added as a party to the hearing of the appeal of the decision of the approval authority, including the lapsing provisions or the conditions, unless the person or public body, before the decision of the approval authority, made oral submissions at a public meeting or written decisions to the council, or in the Ontario Land Tribunal’s opinion, there are reasonable grounds to add the person or public body as a party.
